1. Trademark Opposition and counter-statement explained

When a Trademark is advertised after all due processes of the trademark application, the interested persons or third parties are given an opportunity to file their opposition on the trademark application. The sole purpose of advertisement of the Trademark application is to invite oppositions of the third parties and interested persons in the mark. There may be more than one interested person or third parties in any trademark application. When there are more than one opposition on any trademark the applicant is required to file separate counter-statements against each opposition with payment of separate Government fee and professional fee on case-to-case basis. A trademark opposition may be filed within 120 days from the date of publication of trademark

2. What happens when counter-statement is not filed within stipulated time?

If counter-statement is not filed within the stipulated time of two months the Trademark application shall be considered as abandoned / refused and status of the application shall be shown in the trademark register as abandoned.
